Services Return Policy and Cancellation Agreement
BISTRO BUDDY offers a broad spectrum of digital, creative, and technical services tailored to empower businesses across various stages of growth. Our services span from web design and development, domain management, digital marketing strategies, content creation, to advanced analytics and reporting. This policy outlines our framework for cancellations, refunds, and modifications, ensuring our clients understand their rights and obligations when engaging with our services.
General Terms
Non-refundable Services: Due to the custom nature of most of our services, including but not limited to domain purchasing, DNS management, security services, content creation, and digital marketing strategies, all sales are considered final upon commencement. We commit significant resources to initiate these services; therefore, they cannot be refunded.
Modifications and Cancellations: Requests for service modifications or cancellations must be submitted in writing via support ticket. The ability to modify or cancel a service is subject to the specific terms outlined below for each service category.
Specific Service Terms
Domain Services (Purchasing, Leasing, DNS Management): Given the regulatory and logistical complexities involved, these services are non-refundable. Clients may transfer their domain services following the completion of any contractual period.
Drone Videography and On-Site Services: Cancellations must be made no less than 7 days before the scheduled service date to avoid a cancellation fee of 50%. This accounts for the preparatory work and scheduling commitments.
Content Marketing, Creation, and Consulting: Services cancelled prior to the commencement of the project will incur a cancellation fee of 50%, reflecting the initial resource allocation and planning efforts.
Subscription-Based Services (Web Hosting, Email Marketing, SEO): Subscribers can cancel at any time; however, refunds will not be issued for the current billing cycle. Changes in subscription levels will be applied to the next billing period.
Event Promotion and Organization: Due to the extensive planning involved, cancellations must be communicated at least [specified period] in advance. A [specified amount or percentage] cancellation fee applies, with exceptions made on a case-by-case basis for rescheduling.
Custom Projects and Retainers: Custom projects and retainer-based services are subject to the agreed terms within the individual contract. Early termination may result in a pro-rated charge or forfeiture of the deposit, as detailed in the contract.
Incidental Protections
Limitation of Liability: BISTRO BUDDY shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection to our services provided.
Indemnification: The client agrees to indemnify and hold BISTRO BUDDY harmless from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of the client's use of our services.
Dispute Resolution: Any disputes related to this agreement will be resolved through binding arbitration in [jurisdiction], in accordance with its commercial arbitration rules.
Amendment and Notice
- Policy Changes: BISTRO BUDDY reserves the right to modify this policy at any time. Clients will be notified of significant changes through support ticket.
Acceptance

At BISTRO BUDDY, we connect customers with a wide range of independent local food and drink establishments, including restaurants, food trucks, farmers' markets, breweries, and wineries. Each establishment ("Seller") on our platform is responsible for setting and adhering to its own policies regarding refunds, returns, and exchanges. This diversity reflects the unique offerings and operational capabilities of our Sellers. However, we also set forth platform-wide guidelines to ensure a consistent and fair customer experience.
Seller Refund, Return, and Exchange Policies
- Policy Transparency: Sellers are required to clearly state their refund, return, and exchange policies on each of their BISTRO BUDDY deals listing page. This includes whether such policies are offered, and under what conditions.
- Compliance with Local Laws: Sellers must ensure their policies comply with the local laws and regulations of their jurisdiction. For Sellers operating in the EU and other regions with mandatory return policies, compliance with such laws is required.
- Policy Enforcement: If a Seller enters into a return agreement with a buyer through BISTRO BUDDY’s support ticket system or another approved method, the Seller is obligated to honor that agreement. This may include issuing a refund for the returned item(s) or providing proof of shipping for a replacement item.
Buyer-Seller Dispute Resolution
- Direct Resolution Encouraged: We encourage Buyers to contact Sellers directly through the BISTRO BUDDY platform to resolve any issues related to refunds, returns, or exchanges. Direct communication often leads to faster and more satisfactory resolutions.
- Platform Intervention: In cases where Buyers and Sellers cannot reach a resolution, BISTRO BUDDY may intervene to facilitate a fair outcome. This process is guided by our platform’s policies, the information provided by both parties, and, where applicable, relevant laws and regulations.
Modifications to Seller Policies
- Policy Changes: Sellers are responsible for promptly updating their listing pages to reflect any changes to their refund, return, and exchange policies.
- Buyer Notification: In the event of significant changes to a Seller’s policy, Sellers are encouraged to proactively communicate these changes to potential buyers.
Additional Guidelines
- Digital Orders and Services: For orders that include digital goods or services (e.g., online cooking classes, digital menus, or other non-tangible items), Sellers must specify the conditions, if any, under which refunds or exchanges are offered.
- Custom Orders: Sellers may specify different policies for custom or personalized orders, including but not limited to non-refundability, due to the nature of these offerings.

Account Information
When you purchase services from PageRank Kings or BISTRO BUDDY, we create an account for you. This account makes it easier for you to track and manage your purchases with us. For the purpose of creating your account, we collect what we call "account data" and "registration contact data".

Our use of your account data
PageRank Kings or BISTRO BUDDY only uses account data for the purpose of facilitating the management of your account and billing for your purchases.
We share this data programmatically with Braintree, for the purpose of billing your credit card.
PageRank Kings or BISTRO BUDDY relies on tokens generated by Braintree to trigger billable events. PageRank Kings or BISTRO BUDDY retains the industry-normal first six and last four digits of the credit card, the type of credit card, and the name associated with the credit card for internal tracking and audit purposes. The data is stored securely and is not usable for any billing or charging purposes. Braintree will never use your data for their own purposes without our explicit consent or notice to us.
PageRank Kings or BISTRO BUDDY may share your account data with law enforcement agencies on a case-by-case basis, if necessary, as part of a legal investigation. We may notify you if this happens, depending on the circumstances. PageRank Kings or BISTRO BUDDY may also share your account data with a third party under order from a court of competent jurisdiction related to a lawsuit or investigation. We evaluate these requests on a case-by-case basis, and we will notify you as appropriate.
We may use your account data to contact you concerning a dispute related to your account or for verification purposes to make sure no one else is accessing your account.

Our use of your registration data
PageRank Kings or BISTRO BUDDY only ever uses your registration data for the purpose of facilitating the registration, management, and transfer of the domain names you register with PageRank Kings or BISTRO BUDDY. PageRank Kings or BISTRO BUDDY shares your registration data with the OpenSRS, our sister operating division, and, in turn, that data is shared with the registry that manages the TLD you are registering in, for example, Verisign, for .com; CIRA, for .ca; and Nominet, for .uk. The information we gather for specific registries will be presented to you at the time of your registration.
PageRank Kings or BISTRO BUDDY is also required by ICANN to escrow your registration data with Iron Mountain. Iron Mountain is not permitted to use this data, except to disclose it to ICANN in the event that PageRank Kings or BISTRO BUDDY ceases to be able to register domains.
ICANN requires that we verify the accuracy of the registration data you provide us on at least an annual basis. We use the email address associated with the Registered Name for this purpose. PageRank Kings or BISTRO BUDDY sends this email directly and does not use a third-party service to facilitate this mailing.
If your Registered Domain Name is the subject of a dispute under either ICANN’s Uniform Domain Name Dispute Resolution Policy or its Uniform Rapid Suspension Policy, we will share your registration data with the arbitration provider that is adjudicating the dispute, who will share it with the other party to the dispute. We also may use your registration data to contact you concerning any dispute related to your domain name, or for verification purposes to make sure no one else is accessing your domain.
